They will explain the rules applicable to financial instruments which affect timing and recognition of income and gains and provide an overview of the hedging rules. IRS final regulations on Sec. 475 Mark to Market were just issued in June 2007. Proposed regulations for contingent swaps are complex, include important concepts and revised regulations are expected soon. Have you studied them? The American Jobs Creation Act (enacted in October 2004) and Technical Corrections (enacted in late 2005) revised the straddle rules, and the IRS issued important technical memoranda regarding capitalization of interest by asserting the straddle rules — do you understand the changes and these developments? Additional time will be spent explaining the straddle rules and how they can affect transactions — have you analyzed the implications for your tax planning?
